I Moses Eastes of the Co of Halifax in the Commonwealth of VA, being of purfect sense and memory and in good health thanks be to God for the same - but calling to mind the mortality of my body, knowing that it is appointed for all men to die; and not knowing when that period will arrive to me, have thought it necessesary and expedient to make and publish my last will and testament in manner following (to wit). Imprimis I desire that all my just debts be punctually and honestly paid by my executors hereafter named. Item my will and desire is that whatsoever I have heretofore given to any of my children hereafter named, be executed and considered as so much in evidence of their portion of the distribution of my estate - and to the end that the amount of what they have so received from me may be justly known and to prevent disputes respecting the same I will mention each respectively - To George Eastis my oldest son I have heretofore given a horse & saddle & bed & furniture also one cow, amounting to the value of 40 pounds - To my daughter Clarisa who intermarried with Francis Boyd - To Bartlet Estis my son one mare & saddle, a bed & furniture and a cow value 40 pounds, - To my daughter Patience who intermarried with Peter Holt one bed & furniture value 8 pounds - To my son Laban Estis property to the value of, 30 pounds, and to Winston Estis my son property to the same value, that is to say, 30 pounds now - It is my will that whatsoever, I may died possessed of if every kind both real and personal estate, shall at the death of my beloved wife Luremia Estis and not before be equally divided amongst ALL my (page 354) children Viz George, bartlet, Patience, Laban, Winstone, Judith, Josiah, Moses and Patsey Estis (the said Patsey now intermarried with Robert jackson) in as fair and equitable a manner as possible counting in the sums, respectively advanced to the said George, Clarisa, Bartlet, Patience, Laban and Winstone, as a part of their shares as aforsaid, and so distributing the whole, that each of my said children, shall in the end share an equal and value thereof. Item It is also my will and I do order and direct, that my beloved wife Luremia Estes, remain in possession of my land and plantation whereon I now live on also household & kitchen furniture & other property of every kind of all my stocks of every kind & quantity so long as she shall live for her use, and the benifit & support of my family provided however, if that my said wife should marry again, then in that case the provision herein made for her shall cease and be void and in line thereof she shall be entitled only to what the law allows her. It is further my will and desire that should my said wife Luremia remain my widow until her death that any advancements she may make to any of my children herein named, if she should think proper to make such according to its time value be estimated as a part of their share of my estate herein mentioned and to be so discounted in the final distribution thereof. Lastly, I nominate and appoint my beloved wife Luremia Executrix and my son George and my friend Berryman Green executors of this my last will and testament hoping and trusting confidently that they will see it duly performed - And I do hereby revoke and disannull all other former wills by me made. In witness whereof I have hereunto set my hand seal this 21st day of August in the year of our Lord Christ 1799. Moses Estis Signed, sealed, published & pronounced by the said Moses Estes to be his last will and testament in presence of Arm. Watlington Jr, John Barksdale & H. David Green." Thereupon on motion of Charles D. Fontaine who made oath thereto according to law and for reasons appearing to the Court Certificate is granted him for obtaining letters of administration of the estate of the said Moses Estes Decd with his will foresaid annexed in due form, he giving security whereupon he together with Edward Cornwall his security entered in and acknowledged their bond in the penalty of $5000 conditioned according to law. teste: John Wimbish C.H.C. Truly recorded." [Moses Estes' estate was not settled until about 1835. Unknown when his wife Luremia/Lavinia died. She was still living 22/11/1815 when she was advanced cash for her support. It would seem that she was not his first wife, for there is a deed with a Susannah Estes relinquishing dower and selling to a George Combs.
